Page 47 This policy and disclaimer constitutes the guidelines for acceptable use of computers and internet access at Nova Southeastern University (“NSU”) Library System facilities. The “ Terms and Conditions of NSU Computer and Internet Use ,” “ Policy Accountability, Violations and Sanctions ,” and “ Internet Usage Disclaimer ” sections of this policy will be incorporated in online disclaimer screen on all NSU library computers. NSU provides access to computers and the internet as part of the Libraries’ mission to be “research, cultural and lifelong learning centers for NSU and the community.” The NSU Library System is committed to fulfilling the Libraries’ mission and protecting NSU’s employees, students, guests, and patrons from illegal or damaging actions by individuals, either knowingly or unknowingly. II. Purpose The purpose of this policy is to outline the acceptable use of the internet and computer equipment in NSU Libraries. III. Scope This policy applies to all NSU students, NSU employees and Library guests and patrons. This policy applies to all computer equipment that is owned or leased by NSU, with or without internet access, and all internet usage occurring on that equipment. IV. Definitions “Child pornography” – Pursuant to Florida Statute § 847.001(3), child pornography “means any image depicting a minor engaged in sexual conduct.” “Harmful to Minors” – Pursuant to Florida Statute § 847.001(6), material that is harmful to minors “means any reproduction, imitation, characterization, description, exhibition, presentation, or representation, of whatever kind or form, depicting nudity, sexual conduct, or sexual excitement when it: (a) Predominantly appeals to a prurient, shameful, or morbid interest; (b) Is patently offensive to prevailing standards in the adult community as a whole with respect to what is suitable material or conduct for minors; and (c) Taken as a whole, is without serious literary, artistic, political, or scientific value for minors.” “Obscene” – Pursuant to Miller v. California , 413 U.S. 15 (1973), material is deemed obscene if (a) the average person, applying contemporary community standards, finds the material, as a whole, appeals to the prurient interests; (b) the material depicts or describes, in a patently offensive way, sexual conduct specifically defined by state law; and (c) the material, taken as a whole, lacks serious literary, artistic, political or scientific value. V. Terms and Conditions of NSU Computer and Internet Use All users of NSU Library computers and internet must use these resources in a responsible, courteous, and lawful manner consistent with the libraries’ mission and all computer and internet related rules and regulations including, but not limited to, the following: a) Using computer and internet resources in compliance with the NSU Library Code of Conduct and all applicable NSU policies; b) Using computer and internet resources for cultural, educational, informational or recreational purposes only, not for illegal or unauthorized purposes; c) Complying with all local, state and federal laws, including but not limited to that governing intellectual property, computer-related crimes, electronic communications and fraud and abuse; d) Refraining from using NSU computer and internet resources to access, display, send, receive, print or distribute obscene material, child pornography or materials harmful to minors pursuant to Chapter 857 of the Florida Statutes; e) Refraining from using NSU computer and internet resources in such a way that is fraudulent, abusive, threatening, harassing, disruptive, hostile or intimidating;
