E-Notary
DocuSign offers the ability to execute Electronic Notarial Acts using DocuSign Signature. These Electronic Notarial Acts emulate the core aspects of a traditional paper/human Notarial Act.
Note: if you do not comply with legal requirements for an electronic signature, you can lose your notary license.
Benefits of Remote Electric Notary Sessions
Notaries in Florida (and other select jurisdictions) can use DocuSign eNotary to electronically witness and authenticate the execution of documents. Notaries must have a DocuSign account (currently approved for all NSU faculty and staff) and the electronic notary profile in DocuSign must be set up before DocuSign can be used to notarize documents.
An electronic notary seal is created along with a notarial journal in DocuSign to record the electronic notary sessions, and the details are also captured on the Certificate of Completion of each DocuSign transaction.
DocuSign eNotary Benefits:
- It offers a secure and safe process, an audit trail, and time savings.
- It offers a central repository for recording and reviewing all notarized documents and details of transactions, in one location.
- It makes it easy to attach a notarial certificate, available in eSignature for the notary, based on their jurisdiction.
- It facilitates online notarization and remote online notarization in authorized jurisdictions.
To meet the criteria of new Remote Online Notarization regulations, DocuSign eNotary must be used in conjunction with web conferencing software that meets the necessary legal requirements as noted below (NSU uses Zoom).
- Ability to record the web conferencing session.
- Ability to screen share to witness signing of the documents.
- Remote control passing capabilities so both parties can sign the document electronically.
